1. Introduction

These Terms and Conditions ("Terms", "Terms and Conditions") govern your relationship with the LabCash website located at labcash.games (the "Service") operated by LabCash ("us", "we", or "our").

Please read these Terms and Conditions carefully before using our Service. Your access to and use of the Service is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service.

By accessing or using the Service you agree to be bound by these Terms. If you disagree with any part of these terms then you may not access the Service. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity to this agreement.

2. Eligibility

2.1 Age Requirements

You must be at least eighteen (18) years of age to use the Service, create an account, purchase credits, or participate in any competitions. By using the Service, you represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

We reserve the right to request proof of age at any time and to suspend or terminate any account where satisfactory proof of age has not been provided. Any person who is discovered to be under 18 years of age will have their account immediately terminated, any entries voided, and any prizes forfeited. Credits purchased by underage users will not be refunded except where required by law.

2.2 Geographical Restrictions

The Service is intended primarily for use by residents of the United Kingdom, but we welcome users from other countries to participate in our competitions. You represent and warrant that you are physically located in your stated country of residence at the time of account registration and whenever you access the Service or participate in competitions.

For users outside the United Kingdom, please note that any additional costs associated with prize delivery, including but not limited to international shipping, customs duties, import taxes, or other fees, will be the responsibility of the winner. Alternatively, winners may choose to receive a cash alternative to their prize, the value of which will be discussed and agreed upon at the time of prize claim.

The use of virtual private networks (VPNs), proxy servers, or any other methods to mask your true location or circumvent geographical restrictions is strictly prohibited and will result in immediate account termination. We employ various technical measures to verify user location and reserve the right to void any entries or prizes obtained through location manipulation.

2.3 Account Registration

To access certain features of the Service, you must register for an account. When you register for an account, you agree to provide accurate, current, and complete information about yourself as prompted by the registration form. You further agree to promptly update your account information to maintain its accuracy.

You are solely responsible for maintaining the confidentiality of your account credentials, including your password, and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other breach of security. We will not be liable for any loss or damage arising from your failure to protect your account information.

Each person may maintain only one account. Creating multiple accounts, whether directly or indirectly, is strictly prohibited and will result in the termination of all associated accounts and forfeiture of any credits or prizes. Account sharing, selling, or transferring is also prohibited.

3. Competition Rules

3.1 Entry Methods

We offer two methods of entry into our competitions, both of which provide equal chances of winning:

Paid Entry via Account Balance: Users may add funds to their account balance and use these funds for entries into competitions. Entry ticket prices are set per competition and are clearly displayed on each competition page. Funds must be added using valid payment methods through our secure payment processor. The purchase of entries into competitions constitutes a binding transaction that cannot be reversed except as provided in these Terms or as required by law.

Free Postal Entry: In accordance with UK competition regulations, we provide a free method of entry for all competitions. Users may enter by sending a handwritten letter containing all required information to our designated postal address. Each postal entry must be sent in a separate envelope and contain the user's full name, date of birth, complete address, email address, phone number, and the specific competition they wish to enter. Postal entries are processed within 48 hours of receipt and have exactly the same chance of winning as paid entries. Full details of the free entry process are available in our documentation.

3.2 Account Balance and Purchasing

Your account balance represents the funds available to purchase competition entries. Entry ticket prices vary by competition and are clearly displayed on each competition page. Funds can be added to your account balance in various amounts through our secure payment system. Once added, funds are available immediately for use in any active competition.

All account balance purchases are final and non-refundable. Account balance funds have no cash value and cannot be exchanged for money, transferred to other users, or withdrawn from the Service. Account balance funds do not expire but will be forfeited if your account is terminated for any reason. We reserve the right to modify entry pricing with reasonable notice to users, though any funds already in your account will retain their full value.

The minimum balance top-up is £5.00 and the maximum single purchase is £5,000.00. We may impose daily, weekly, or monthly purchase limits at our discretion to promote responsible participation. Any attempt to circumvent purchase limits through multiple accounts or other means will result in account termination.

3.3 Competition Mechanics

Each competition operates on a fixed-ticket model where a predetermined number of entry tickets are available. Competitions remain active until all available tickets have been claimed, at which point the competition closes automatically and proceeds to winner selection.

Winners are determined through a cryptographically secure random selection process that ensures complete fairness and transparency. We utilize certified random number generation services that provide auditable proof of randomness. The selection process cannot be influenced by any party, including our staff, and all entries have an exactly equal probability of being selected.

Competition parameters, including ticket price, total tickets available, and prize details, are clearly displayed on each competition page and cannot be modified once the competition has begun accepting entries. We reserve the right to extend competition deadlines if technical issues prevent normal operation, but we will never reduce the number of tickets available or otherwise disadvantage existing entrants.

In the unlikely event that a competition must be cancelled before completion, all entrants will be refunded their entry fees to their account balance. If a competition is cancelled after some entries have been made through free postal entry, we will conduct the draw with the existing entries or offer those entrants the option of a full refund of their postal costs.

3.4 Prize Claims and Delivery

Winners are notified via email and telephone within 24 hours of the competition draw. Winners must respond to our notification and claim their prize within seven (7) calendar days. Failure to claim a prize within this timeframe may result in disqualification and selection of an alternative winner.

To claim a prize, winners must provide valid photographic identification and proof of address. We may require additional verification for high-value prizes. Winners must be the registered account holder who entered the competition; prizes cannot be claimed by third parties except where the winner has become incapacitated or deceased, in which case standard legal processes apply.

Prizes are awarded as described in the competition listing and cannot be exchanged for cash or alternative items except where we are unable to provide the advertised prize, in which case we will offer a substitute of equal or greater value. Physical prizes are delivered to UK addresses only, with standard delivery included. Winners may request special delivery methods at their own expense.

4. Prohibited Activities

In using the Service, you expressly agree that you will not engage in any of the following prohibited activities:

Account Violations: You shall not create, maintain, or control multiple accounts, whether directly or indirectly through other persons. You shall not share, sell, transfer, or permit any other person to access your account. You shall not misrepresent your identity or impersonate any person or entity.

Technical Manipulation: You shall not use automated systems, bots, scripts, or any mechanical or electronic devices to access the Service or enter competitions. You shall not attempt to interfere with, disrupt, or disable any features of the Service, including security features. You shall not attempt to gain unauthorized access to any portion of the Service, other accounts, or computer systems or networks connected to the Service.

Competition Integrity: You shall not engage in any activity designed to manipulate competition outcomes or obtain an unfair advantage. You shall not collude with other users to affect competition results. You shall not exploit any errors, bugs, or vulnerabilities in the Service for gain. You shall not make false claims regarding prizes or create fake winner testimonials.

Fraudulent Conduct: You shall not provide false information during registration or prize claims. You shall not use stolen or unauthorized payment methods. You shall not engage in money laundering or any financial crimes through the Service. You shall not initiate chargebacks or payment disputes for validly processed transactions without first attempting resolution through our support channels.

Abusive Behavior: You shall not harass, threaten, or abuse other users or our staff. You shall not post or transmit offensive, obscene, or inappropriate content. You shall not engage in any form of discrimination or hate speech. You shall not use the Service to conduct any illegal activities.

Violation of any of these prohibitions will result in immediate account suspension or termination, forfeiture of any credits or prizes, and may result in legal action. We actively monitor for prohibited activities and employ various technical and manual methods to detect violations.

5. Payment Terms

5.1 Payment Processing

All payments for account balance top-ups are processed through our third-party payment processor. By making a purchase, you agree to our payment provider's terms of service and privacy policy. We do not store or have access to your complete payment card information; all sensitive payment data is handled directly by our payment provider in compliance with Payment Card Industry Data Security Standards (PCI DSS).

Prices are displayed in British Pounds Sterling (GBP) and include any applicable Value Added Tax (VAT) or other taxes. The price shown at the time of purchase is the price you will pay. We accept major credit and debit cards, including Visa, Mastercard, and American Express. Alternative payment methods may be offered at our discretion.

5.2 Refund Policy

All account balance purchases are final and non-refundable. Once funds have been added to your account, they cannot be refunded, exchanged for cash, or transferred to another user. This policy is clearly stated at the point of purchase and your completion of a purchase constitutes acceptance of this policy.

Exceptions to our no-refund policy may apply in the following limited circumstances: (1) where required by applicable consumer protection laws; (2) where technical errors resulted in incorrect balance allocation; (3) where we are unable to provide the Service for an extended period; or (4) where unauthorized transactions have occurred due to security breaches on our systems.

To request consideration for a refund exception, you must contact our support team within 14 days of the transaction with full details of your claim. All refund requests are reviewed on a case-by-case basis and approval is at our sole discretion except where legally required.

5.3 Payment Failures and Disputes

If a payment transaction fails, no funds will be added to your account. Common reasons for payment failure include insufficient funds, incorrect card details, or bank security checks. You may retry the transaction once the issue has been resolved. Multiple failed payment attempts may result in temporary or permanent suspension of your ability to add funds to your account.

In the event of a payment dispute or chargeback initiated with your card issuer, your account will be immediately suspended pending resolution. If a chargeback is completed in your favor, any funds added in the disputed transaction will be removed from your account. Initiating a chargeback for a valid transaction may result in permanent account termination and legal action to recover funds.

6. Prize Fulfillment and Delivery

6.1 Prize Delivery Process

Physical prizes will be dispatched within fourteen (14) business days of prize claim verification. We use reputable courier services for all deliveries and will provide tracking information where available. Delivery times beyond our dispatch are subject to courier service levels and are not guaranteed, though we will make reasonable efforts to ensure timely delivery.

Digital prizes, including vouchers, codes, or electronic items, will be delivered via email to the winner's registered email address within forty-eight (48) hours of claim verification. Winners are responsible for ensuring their email address is current and for checking spam folders. We are not responsible for digital prizes that cannot be delivered due to incorrect email addresses or technical issues on the recipient's end.

Prizes are delivered to addresses within the United Kingdom at no additional cost to the winner. For international winners, prizes can be shipped internationally, but all additional costs including shipping, customs duties, import taxes, and other fees will be the responsibility of the winner. International winners may alternatively choose to receive a cash alternative to their prize, the value of which will be determined and agreed upon at the time of prize claim.

For certain high-value prizes, we may require signature on delivery or collection from a designated location. Winners will be notified of any special delivery requirements.

6.2 Delivery Costs and Options

Standard UK delivery is included in all prizes at no additional cost to UK winners. This typically includes courier or postal service delivery to the provided address during normal business hours. For international winners, all shipping costs, customs duties, import taxes, and other delivery-related fees are the responsibility of the winner. Winners who require special delivery arrangements, such as weekend delivery, timed delivery slots, or delivery to alternative addresses, may request these services at their own expense.

For prizes requiring installation or setup, such as large appliances or complex electronics, standard delivery includes only transportation to the address. Any installation, setup, or disposal of old items is the winner's responsibility unless specifically stated in the prize description.

6.3 Prize Substitution and Availability

We make every effort to provide prizes exactly as described in the competition listing. However, we reserve the right to substitute any prize with an alternative of equal or greater value if the original prize becomes unavailable due to circumstances beyond our control, including but not limited to discontinuation by the manufacturer, supply chain issues, or changes in legal regulations.

In the event of prize substitution, winners will be notified of the change and given full details of the alternative prize. If a winner objects to a substitution, they may decline the prize, but no cash alternative or credit refund will be offered. The decision to substitute prizes is at our sole discretion and is final.

7. Intellectual Property Rights

7.1 Our Intellectual Property

All content on the Service, including but not limited to text, graphics, logos, images, audio clips, digital downloads, data compilations, and software, is the property of LabCash or its content suppliers and is protected by United Kingdom and international copyright laws. The compilation of all content on the Service is our exclusive property and is protected by UK and international copyright laws.

Our trademarks, service marks, and logos used and displayed on the Service are our registered and unregistered trademarks. You may not use our trademarks in connection with any product or service without our prior written consent. You may not use our trademarks in any manner that disparages or discredits us, or in any manner that is likely to cause confusion among users.

Nothing in these Terms grants you any right to use any of our intellectual property except as expressly set forth herein. You may not reproduce, distribute, modify, create derivative works of, publicly display, republish, download, store, or transmit any of the material on our Service except as incidentally necessary to view the Service on your device.

7.2 User-Generated Content

By submitting, posting, or displaying content on or through the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content in any media. This license exists for the purpose of operating, promoting, and improving the Service.

You retain all rights to your content, subject to the license granted to us. You represent and warrant that you own or have the necessary licenses, rights, consents, and permissions to grant us this license for all content you submit. You further warrant that your content does not infringe, violate, or misappropriate the rights of any third party.

We have the right but not the obligation to monitor and edit or remove any content posted on the Service. We take no responsibility and assume no liability for content posted by you or any third party.

8. Privacy and Data Protection

8.1 Data Processing

Our collection, use, and processing of your personal data is governed by our Privacy Policy, which forms an integral part of these Terms. By using the Service, you acknowledge that you have read and understood our Privacy Policy and consent to the data practices described therein.

By creating an account, you consent to receive electronic communications from us relating to your account, including but not limited to account verification, security alerts, prize notifications, and important service updates. These service-related communications are considered part of the Service and you may not opt out of receiving them while maintaining an account.

Marketing communications, including promotional emails about new competitions, special offers, and Service features, require your separate explicit consent. You may withdraw consent for marketing communications at any time by using the unsubscribe link in any marketing email or by updating your communication preferences in your account settings. Withdrawal of marketing consent does not affect service-related communications.

9. Disclaimers and Limitation of Liability

9.1 Service Availability and Warranties

The Service is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied. While we strive to maintain Service availability 24 hours a day, 7 days a week, we do not guarantee uninterrupted or error-free operation of the Service. We expressly disclaim all warranties of any kind, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We reserve the right to interrupt the Service for maintenance, updates, or improvements. Where possible, we will provide advance notice of scheduled maintenance, but emergency maintenance may be performed without notice. We shall not be liable for any loss or damage resulting from Service interruptions, regardless of the cause or duration.

9.2 Limitation of Liability

To the fullest extent permitted by law, LabCash, its officers, directors, employees, agents, suppliers, or affiliates, shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including without limitation damages for loss of profits, goodwill, use, data, or other intangible losses, resulting from your use or inability to use the Service.

In no event shall our total liability to you for all damages, losses, and causes of action exceed the amount you have paid to us in the twelve (12) months preceding the claim. This limitation applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if we have been advised of the possibility of such damage.

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

9.3 Indemnification

You agree to defend, indemnify, and hold harmless LabCash, its affiliates, and their respective officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable legal fees) arising out of or relating to your violation of these Terms or your use of the Service.

This indemnification obligation includes but is not limited to claims arising from: (a) your breach of any representation or warranty contained in these Terms; (b) your violation of any applicable law or regulation; (c) your infringement of any intellectual property or other rights of any third party; (d) any content you submit to the Service; or (e) your fraudulent or illegal use of the Service.

We reserve the right, at our own expense, to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

10. Account Suspension and Termination

10.1 Voluntary Account Closure

You may request closure of your account at any time by contacting our support team. Account closure requests will be processed within 48 hours of receipt. Upon account closure, you will lose access to all Service features and any remaining account balance will be forfeited. Account closure is permanent and irreversible; if you wish to use the Service again in the future, you will need to create a new account.

Before closing your account, you should ensure that you have claimed any prizes won and have no pending competition entries. We will not be responsible for unclaimed prizes or active entries after account closure. Any remaining account balance will be forfeited upon account closure. Personal data associated with closed accounts will be retained or deleted in accordance with our Privacy Policy and applicable data protection laws.

10.2 Suspension and Termination by Us

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason at our sole discretion. Suspension may be temporary or permanent depending on the nature and severity of the violation. During suspension, you will not be able to access your account, enter competitions, or add funds to your account.

Immediate termination without prior notice may occur for serious violations including but not limited to: fraud or attempted fraud, multiple account creation, harassment of staff or users, technical manipulation of the Service, or any illegal activities. In cases of less severe violations, we may provide warning before suspension or termination.

Upon account termination for Terms violations, all account balance funds are forfeited, any pending competition entries are voided, and any unclaimed prizes are revoked. We shall have no obligation to refund any account balance or compensate for any losses resulting from account termination for cause. Terminated users are prohibited from creating new accounts, and we reserve the right to take legal action to enforce this prohibition.

11. Dispute Resolution

11.1 Informal Resolution

In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the Service, you agree to first attempt to resolve the dispute informally by contacting our support team. We will make reasonable efforts to resolve any dispute through good-faith negotiations. Most disputes can be resolved satisfactorily through this informal process.

To initiate informal resolution, you must send a written notice describing the nature and basis of your claim and the specific relief sought. We will have thirty (30) days to respond to your notice and attempt to resolve the dispute. You agree not to initiate any formal proceedings until this informal resolution process has been exhausted.

11.2 Governing Law and Jurisdiction

These Terms and any dispute arising out of or related to them or the Service shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply.

If informal resolution is unsuccessful, you agree that any legal action or proceeding shall be brought exclusively in the courts of England and Wales. You hereby irrevocably consent to the jurisdiction of such courts and waive any objection to venue in such courts. Each party shall bear its own costs and legal fees in any dispute, except where prohibited by law or where a party has engaged in willful misconduct.

12. Modifications to Terms

We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. When we make changes, we will update the "Last Updated" date at the top of this document. The updated Terms will be effective immediately upon posting, except that material changes that adversely affect your rights will become effective thirty (30) days after notice.

For significant changes that materially affect your rights or obligations, we will provide notice through the email address associated with your account. It is your responsibility to ensure your email address is current. We may also provide notice through the Service interface or other reasonable means.

Your continued use of the Service after the effective date of any changes constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and close your account. We recommend that you regularly review these Terms to stay informed of any changes.

13. Competition-Specific Terms and Conditions

13.1 Fair and Random Selection Process

All competition draws are conducted using cryptographically secure random number generation provided by certified third-party services. These services provide auditable proof of randomness and ensure that the selection process cannot be influenced or predicted by any party. The random selection process is initiated automatically when a competition reaches its ticket limit.

Draw results are final and binding. No correspondence will be entered into regarding draw outcomes. The entire selection process is logged and archived for regulatory compliance and can be reviewed by appropriate authorities if required. Winners are selected based on their entry numbers, which are assigned sequentially as entries are received and processed.

13.2 Winner Notification and Announcement

Winners are notified via the email address and telephone number provided during registration within 24 hours of the draw. We will make up to three attempts to contact winners by each method. Winners must respond and claim their prize within seven (7) days of initial notification. Failure to respond within this timeframe may result in disqualification and selection of an alternative winner.

Public announcement of winners is made on our website and social media channels after the winner has been verified and has claimed their prize. To protect winner privacy, public announcements include only the winner's first name and last initial, along with their general location (e.g., "John S. from London"). Winners may choose to provide additional information or testimonials at their discretion.

13.3 Odds and Transparency

The odds of winning any competition depend on the total number of entries received. Each valid entry, whether purchased or submitted via free postal entry, has an exactly equal chance of being selected. Current odds are calculated as 1 divided by the total number of entries and may be displayed on competition pages.

We are committed to transparency in our operations. Competition parameters, including total tickets available, tickets sold, and entry deadline, are clearly displayed on each competition page. This information is updated in real-time to ensure participants can make informed decisions about their participation.

14. Responsible Participation

14.1 Our Commitment to Responsible Gaming

While our competitions are games of chance based on skill-free draws rather than gambling, we are committed to promoting responsible participation. 15. General Provisions

These Terms supersede all prior or contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding the Service.

15.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable. If such modification is not possible, the relevant provision shall be deemed deleted. Any modification to or deletion of a provision shall not affect the validity and enforceability of the rest of these Terms.

15.3 Waiver

No waiver of any term or condition of these Terms shall be deemed a further or continuing waiver of such term or condition or any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

15.4 Assignment

You may not assign or transfer these Terms, by operation of law or otherwise, without our prior written consent. Any attempt by you to assign or transfer these Terms without such consent shall be null and void. We may freely assign or transfer these Terms without restriction. Subject to the foregoing, these Terms will bind and inure to the benefit of the parties, their successors, and permitted assigns.
